WIMBLE OCCUPANTS OF: 3833 VT Route 313W, Arlington VT MORTGAGEE'S NOTICE OF FORECLOSURE SALE OF REAL PROPERTY UNDER 12 V.S.A. sec 4952 et seq. In accordance with the Judgment Order and Decree of Foreclosure entered September 22, 2020, in the above captioned action brought to foreclose that certain mortgage given by the late Donald R. Wimble to Kittredge Mortgage Corporation , dated June 21, 2006 and recorded in Book 126 Page 506 of the land records of the Town of Arlington, of which mortgage the Plaintiff is the present holder, by virtue of the following Assignments of Mortgage: (1) Assignment of Mortgage from Kittredge Mortgage Corporation to Mortgage Electronic Registration Systems, Inc.as nominee for Mortgage Network, Inc. dated June 21, 2006 and recorded in Book 126 Page 516; (2) Assignment of Mortgage from Mortgage Electronic Registration Systems, Inc. as nominee for Mortgage Network, Inc. to Bank of America, N.A. dated July 14, 2015 and recorded in Book 152 Page 393; (3) Assignment of Mortgage from Bank of America, N.A. to Specialized Loan Servicing, LLC dated May 14, 2018 and recorded in Book 158 Page 411 all of the land records of the Town of Arlington for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 3833 VT Route 313W, Arlington, Vermont on December 8, 2020 at 11:00 AM all and singular the premises described in said mortgage, To wit: Being all and the same lands and premises conveyed to Darrin M. Jennings and Kendell J. Jennings by Harry W. Brown, Executor of the Estate of Fred Tyo, by Executor's Deed of dated December 15, 1993 and recorded December 17, 1993 in Book 74 at Pages 174-177 of the Arlington Land Records and being more particularly described therein as follows: "Being all and the same lands and premises, together with improvements thereon, conveyed to Fred Tyo and Etta L. Tyo (predeceased wife of Fred Tyo) by Warranty Deed from Harry W. Brown, Jr, dated August 3, 1964 and recorded in Volume 32 at Page 474 of the Arlington Land Records and described therein as follows: "''It being all and the same lands and premises described in a deed from HARRY W. BROWN, SR. to JOHN L. WIIALEN dated July 11, 1950 and recorded in Book 28, Page 220 Arlington Land Records and therein described as follows: "''All and the same lands and premises described in the First Parcel in a deed from Edwin G. Farnham and Stella J. Farnham to Reuben Bentley and Eliza, his wife, dated April 28. 1914 recorded in Book 21, page 60. Bounded as follows: "''On the east by land known as the Austin Place. now owned and occupied by Etta L. Brown, on the south by land formerly owned by Stephen Hill, now owned by Paul Bedell; on the west by land formerly owned by Mrs. Reuben Bentley, and now owned by Carl and Marjorie Hess; and on the north by the main highway leading from West Arlington. so-called, to New York State Line. The above Parcel to contain one-half acre of land, "''It being the same land conveyed by Eliza Bentley to Harry W. and Etta L. Brown, recorded in Book 24. Page 326 of the Arlington Land Records and decreed to Harry W. Brown by the Bennington County Court.' "''It also being the same lands and premises conveyed by JOHN L. WHALEN to HARRY W. BROWN, Sr. and HARRY W. BROWN, Jr. as joint tenants with right of survivorship in a deed dated July 11. 1950 and recorded in Book 28. Page 221 of the Arlington Land Records. The said HARRY W. BROWN. Sr. is now deceased.'" Reference is hereby made to the above instruments and to the records and references contained therein in further aid of this description. Terms of sale: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described. TEN THOUSAND ($10,000.00) Dollars of the purchase price must be paid by a certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid by a certified check, bank treasurer's or cashier's check within sixty (60) days after the date of sale. The mortgagor is entitled to redeem the premises at any time prior to the sale by paying the full amount due under the mortgage, including the costs and expenses of the sale.
