ACT 250 NOTICE MINOR APPLICATION #8B0163-13 10 V.S.A. 6001 - 6093 On March 5, 2021, OSJ of Bennington VT LLC f/k/a OSJ of Rutland VT LLC, 375 Commerce Park Road, North Kingstown, RI 02852 and OSJ Of Bennington VT LLC, 375 Commerce Park Road, North Kingstown, RI 02852 filed application number 8B0163-13 for a project generally described as adjustments to the portion of the existing building identified as the Former JC Penney building on Exhibit 003 ("Unit 6"), which was previously used by JC Penney for retail uses, to allow Applicant to use Unit 6 for its retail uses. Applicant proposes to make the following adjustments: update the building's facade as shown on Exhibit 004, which is to include replacing the existing facade sign with the Applicant's sign as shown on Exhibit 005 and replace the existing loading dock at the exterior entrance to Unit 6 as shown on Exhibits 006, 007, and 008. The project is located 95 Bennington Square in Bennington, Vermont. No hearing will be held, and a permit will be issued, unless on or before April 28, 2021, a party notifies the District 8 Commission in writing at the address below of an issue requiring a hearing, or the Commission sets the matter for a hearing on its own motion. Any person as defined in 10 V.S.A. 6085(c)(1) may request a hearing. Any hearing request must be in writing to the address below, must state the criteria or sub-criteria at issue, why a hearing is required and what additional evidence will be presented at the hearing. Any hearing request by an adjoining property owner or other person eligible for party status under 10 V.S.A. 6085(c)(1)(E) must include a petition for party status under the Act 250 Rules. Findings of Fact and Conclusions of Law may not be prepared unless the Commission holds a public hearing.
