NOTICE OF SALE By virtue of the order for public sale contained in the Judgment and Decree of Foreclosure by Judicial Sale issued by this Court in favor of the Plaintiff, Heritage Family Federal Credit Union, dated March 18, 2020, the lands and premises which are the subject of this foreclosure action will be sold at Public Auction at 10:00 a.m. on the 28th day of April, 2021, at 434 Dufresne Pond Road, Town of Manchester, County of Bennington and State of Vermont. The sale shall be conducted by a sheriff or any licensed auctioneer. The property to be sold is all and singular the premises as described in the subject Mortgage Deed from Peter J. Niles and Danielle Niles to Heritage Family Federal Credit Union, dated October 23, 2017 and recorded in the Town of Manchester Land Records in Book 336 at Page 489. The lands and premises are more particularly described as follows: Being the same lands and premises conveyed to Rose Dorr and Danielle Niles by Quit Claim deed of Donald Dorr, Patricia Dorr and Douglas Dorr dated February 12, 2012 and March 2, 2012 and recorded March 13, 2012 in Book 304 at Page 161 of the Manchester, Vermont Land Records and described therein as follows: Being all and the same lands and premises conveyed to Donald Dorr, Patricia Dorr and Douglas Dorr by Administrator's Deed of the Estate of Raymond R. Hulett dated April 4, 2001 and recorded on April 9, 2001 in Book 195 at Page 115 of the Manchester Land Records, and therein more particularly described as follows: Being all and the same lands and premises as decreed to Raymond Hulett by Decree of Partial Distribution of the Manchester Probate Court in re: Estate of Florence C. Kelton, dated June 25, 1996 and recorded July 15, 1996 in Book 162, Page 135 of the Barrington (sic) Land Records. Said lands and premises are more particularly described as follows: Parcel 1: Being all and the same lands and premises conveyed to Florence C. Kelton and Mary E. Hulett, as joint tenants (the said Mary B. Hulett having predeceased Florence C. Kelton), by James B. Campbell, by Quit-Claim Deed dated July 31, 1957 and recorded August 1, 1957 in Book 51 at Pages 505 and 506 in the Town of Manchester Land Records. Said lands are more particularly described therein as follows: Beginning at an iron post at the south east corner of lands of Joseph Myette; thence southerly along the line of lands formerly of Jessie B. Eaton, 169 feet to the south-east corner of the lands herein described; thence westerly on land of said Eaton, 56 feet to a stake; thence northerly along the line of Caspar Bromley, 168 feet to land of said Joseph Myette; thence easterly, 56 feet, following the fence between lands of said Myette and the lands herein described to the place of beginning. Said lands are now supposed to be bounded on the east by lands of Bernard Dow and wife; on the south, west and north by lands of Stanley Peterson. Also being the same lands conveyed to the Grantor herein by the said Mary Belle Hulett by deed of even date herewith. Parcel II: Being all and the same lands conveyed to Florence C. Kelton and the aforesaid Mary Hulett (as joint tenants with rights of survivorship) by Bernard J. Dow and Cora B. Dow by Warranty Deed dated September 3, 1964 and recorded September 19, 1964, in Book 56 at Page 127 of said land records. Said lands are more particularly described therein as follows: A parcel of land located on the northwest side of a twenty foot right of way leading to lands of the State of Vermont Fish and Game Service from the Dufresne Pond Road, so-called, bounded and described as follows: Beginning at a stake driven in the ground at the southerly corner of lands of the Grantees, said stake being located 32 feet and 6 inches from the south corner of the foundation of the garage on lands of the Grantees, and 56 feet from an iron pipe marking the westerly corner of lands of the Grantees, thence, from said stake north 56 degrees 59 minutes east along the Grantees' lands 84 feet and 4 inches to a stake driven in the ground about 4 feet southeasterly from a fence post; thence turning an angle of 90 degrees and running south 33 degrees 01 minute east 55 feet and 10 inches to an iron pin driven in the ground on the northwesterly side of said right of way; thence south 70 degrees 36 minutes west along said right of way 86 feet and 9 inches to an iron pipe; and thence north 33 degrees 01 minute west 35 feet and 5 inches to the point of beginning. Containing 0.088 acre of land, be the same more or less. Said land is bounded on the northwest by lands of the Grantees, on the northeast by lands of the Grantors, on the southeast by said right of way, and on the southwest by lands of the Grantors, including the right, in common with the Grantors and others, to use said right of way for purposes of travel. The above description has been prepared from a survey made by Charles H. Grant dated December 12, 1962. Being a part of the lands which were conveyed to the Grantors by Lilian Eaton by deed dated April 20, 1925, recorded in Vol. 33 at Page 354 of the Manchester Land Records. Reference may be had to said deed, survey and land records for further and more particular description of the lands hereby conveyed. Parcel III: Being all and the same lands and premises conveyed to Florence C. Kelton by James L. Wiley and Ellen L. Wiley by Warranty Deed dated and recorded August 29th, 1969 in Book 60 at Page 395 of said land records. Said lands are more particularly described therein as follows: Beginning at a point which marks the southwest corner of William T. Bushee, Jr.; northwest corner of Florence Kelton and the northeast corner of James L. Wiley and wife; thence in a general southwesterly direction 169 feet, more or less, along the west line of Kelton to a pipe set in the ground and painted yellow; thence turning an included angle and running in a general westerly direction 30 feet, more or less, along the north line of Eugene Moffitt to a pipe set in the ground; thence running an included angle and running in a northeasterly direction 171 feet, more or less, through lands of the Grantors to the point of beginning. Said triangular piece of land is subject to a right of way to be used in common with the Grantors and William T. Bushee, Jr. and Stanley Peterson and wife, together with their heirs and assigns. Meaning and intended (sic) hereby to convey also all septic tank and sewerline rights and easements of Florence Kelton located on the above described parcel, being a part of the same lands and premises conveyed to James L.
