In accordance with the Judgment Order and Decree of Foreclosure entered March 30, 2020 in the above captioned action brought to foreclose that certain mortgage given by Francis E. Darcy and Anne Darcy to Heritage Conveyance Corporation, dated May 5, 1988 and recorded in Book 76 Page 381 of the land records of the Town of Winhall, of which mortgage the Plaintiff is the present holder, by virtue of the following Assignments of Mortgage: (1) An Assignment of Mortgage from Heritage Conveyance Corporation to Heritage -NIS Bank for Savings dated May 10, 1988 and recorded in Book 77 Page 46; and (2) An Assignment of Mortgage from Bank of America, N.A., successor by merger to Fleet National Bank of Connecticut, s/b/m to Fleet bank of Massachusetts, N.A., s/b/m Heritage Bank for Savings FKA Heritage/NIS Bank for Savings to U.S. Bank Trust, N.A., as Trustee for LSF9 Master Participation Trust dated June 5, 2017 and recorded in Book 210 Page 425 both of the land records of the Town of Winhall for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 180 High Meadow Road fka Lot#D9, High Meadows, Winhall, Vermont on April 29, 2021 at 11:00 AM all and singular the premises described in said mortgage, To wit: Being all and the same land and premises conveyed to the Grantor herein by Warranty Deed of the Stratton Corporation dated April 16, 1987 and recorded April 20, 1987 in Book 69, Page 192 of the Winhall Land Records. Said lands and premises are more particularly described therein as follows: "Being Lot #D9 of the High Meadows Subdivision as shown on a plan or survey entitled 'Plat of Block D lots, High Meadows Subdivision, for the Stratton Corporation, Winhall, Vermont', dated March 30, 1984, and prepared by Associated Consultants, Inc., environmental engineers and planners, of South Londonderry, Vermont, said plat having been recorded in the Winhall Land Records on April 18, 1984, to which reference is hereby made for a more particular description of the premises herein conveyed. "Reserving to the Grantor, The Stratton Corporation, its successors and assigns, from and out of this above granted premises such streets and roads as are now plotted or laid out through the premises hereby granted, and further reserving to The Stratton Corporation, its successors and assigns, successors and assigns, such rights of way and easements from and out of the above-granted premises for the construction and maintenance of water supply and sewage pipe lines, electric conduits, and telephone and telegraph poles and lines in and upon the described premises. "The foregoing real estate is hereby expressly conveyed and transferred subject to the terms and conditions of the Declaration of Protective Covenants, Restrictions, and Reservations adopted by The Stratton Corporation on September 8, 1962, which were recorded on December 16, 1962 in Book 19, Pages 352-358 of the Winhall Land Records, and as amended to add the High Meadows Subdivision, which amendment is dated August 23, 1983, and is recorded in Book 47, Page 451 of the Winhall Land Records. "The foregoing premises are further expressly conveyed subject to the terms and conditions of a certain Land Use Permit #2H0519-3 recorded in Book 47, Page 60 of the Winhall Land Records to which reference is hereby made." Reference is hereby made to the above instruments and to the records and references contained therein in further aid of this description. Terms of sale: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described. TEN THOUSAND ($10,000.00) Dollars of the purchase price must be paid by a certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid by a certified check, bank treasurer's or cashier's check within sixty (60) days after the date of sale.
