BAXTER, Defendants NOTICE OF SALE By virtue and in execution of the Power of Sale contained in a certain mortgage given by Evelyn L. Baxter to Adams Community Bank, dated September 26, 2014, and recorded in Book 85 at Page 238 of the Town of Stamford Land Records, of which mortgage the undersigned is the present holder, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 11:00 a.m. on April 2, 2021, at 1580 Main Road, Stamford, Vermont 05352, all and singular the premises described in said mortgage. To wit: The land with any and all buildings thereon situate in Stamford, Bennington County, Vermont, being bounded and described as follows: Beginning at a point in the easterly line of said Main Road twenty (20) feet northerly from the north-westerly corner of land conveyed to Clayton J. Slade et ux by deed of Albert W. Foster dated April 1, 1954 recorded in Stamford Land Records in Book 26 at Page 78; thence easterly in a line parallel with the northerly line of said land of Slade a distance of three hundred (300) feet along other land now or formerly of Albert W. Foster to an iron pipe; thence northerly in a line parallel with the easterly line of said Main Road a distance of one hundred fifty (150) feet along other land now or formerly of said Foster to an iron pipe; thence westerly in a line parallel with the first mentioned bound a distance of three hundred (300) feet along other land now or formerly of said Foster to an iron pipe in the easterly line of said Main Road; thence southerly along said Main Road a distance of one hundred fifty (150) feet to the point of beginning. MEANING and INTENDING to convey and hereby expressly conveying, in mortgage, the same premises conveyed to me and Leo Luczynski by deed of Albert W. Foster, dated May 11, 1954, recorded with Stamford, Vermont Land Records in Stamford, Vermont on May 12, 1954, in Book 26, Page 83-84; being the same premises conveyed to me by deed of myself and Leo Luczynski dated March 30, 1992 and recorded with said Land Records in Book 48, Page 168. Plaintiff may postpone the sale for a time not exceeding 10 days, or sooner, from time to time until the sale is completed, giving notice of such adjournment by public proclamation at the time and place appointed for said sale. TERMS OF SALE: Purchaser shall pay in cash or certified funds or produce a commitment letter from a bank or mortgage company or other lender licensed to do business in the State of Vermont at the time of the sale. In any case, a $10,000 cash deposit is required at the time of sale. The sale is subject to taxes due and owing to the Town of Stamford. The Mortgagor is entitled to redeem the premises at any time prior to the sale by paying the full amount due under the mortgage, including the costs and expenses of sale.
